Acceptable Use Policy
- The MSU Alumni Association ("MSU Alumni Association") provides computing
and information services (the "Services") to those persons ("Users") who utilize
its Service.
- By using the Service, each User agrees to be bound by all of the Conditions
of Use set forth in the following paragraphs.
- No User may reproduce, or otherwise utilize, for commercial purposes the
information provided by the MSU Alumni Association through the Service without
the written permission of the MSU Alumni Association. Consequently, without
such written permission, no User may resell or commercially exploit the names,
addresses or other data obtained by use of the service.
- Each User acknowledges that the MSU Alumni Association has copyrighted the
contents of the Service as a compilation copyright and that reproductions,
redistribution or publication of such content is prohibited without the express
written consent of the MSU Alumni Association.
- The MSU Alumni Association reserves the right in its sole discretion to
deny access to any User.
- By providing information to the MSU Alumni Association,
each User hereby grants permission for the MSU Alumni Association to use such
information for any purpose unless a restriction on such use is transmitted
to the MSU Alumni Association by email prior to such use. The MSU Alumni Association
shall not, however sell such information to any person for the purpose of
solicitation of any kind. (See the MSU Alumni
Association Privacy Policy document).
- Each User hereby indemnifies the MSU Alumni Association against any liability
relating to the MSU Alumni Association's use of information provided by such
User or relating to such User's violation of these Conditions of Use.
- Each User agrees to discontinue any communication with persons listed in
the MSU Alumni Association directory or in the MSU alumni registry database
upon the request of such persons.
- The MSU Alumni Association undertakes no responsibility to review the contents
of any information provided to Users, including but not limited to information
accessed through links to other sites and forwarded email, and by using the
Service each User agrees that the MSU Alumni Association shall have no liability
for such contents.
- MSUALUM.COM addresses may not be utilized as return addresses for commercial
email solicitations, advertising, offensive or illegal communications, communications
which infringe intellectual property rights, or communications which harass,
intimidate or otherwise violate the rights of others. The MSU Alumni Association
reserves the right to terminate the MSUALUM.COM registration of any person
who violates this policy.
- The MSU Alumni Association may modify these Conditions of Use at any time
by publication through the Service.
- EACH USER EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT THE USER'S SOLE
RISK. NEITHER THE MSU ALUMNI ASSOCIATION NOR ANY OF ITS LICENSORS, EMPLOYEES,
OR AGENTS WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE; NOR
DOES THE MSU ALUMNI ASSOCIATION OR ANY OF ITS LICENSORS, EMPLOYEES OR AGENTS
MAKE ANY WARRANTY AS TO THE RESULTS TO BE OBTAINED FROM USE OF THE SERVICE.
THE SERVICE IS DISTRIBUTED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND,
EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE
OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
OR OTHERWISE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE
OF EXCLUSION, RESTRICTION, OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS
SERVICE. NEITHER THE MSU ALUMNI ASSOCIATION NOR ANY ONE ELSE INVOLVED IN CREATING,
PRODUCING, OR DELIVERING THE SERVICE SHALL BE LIABLE FOR ANY DIRECT, INDIRECT,
INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF USE OF THE SERVICE
OR INABILITY TO USE THE SERVICE OR OUT OF ANY BREACH OF ANY WARRANTY.
